    Lausanne - Eigentlich ist es eine Szene, die zum Polizeialltag gehört: Ein Beamter nimmt einen Mann wegen des Verdachts auf Taschendiebstahl fest.

    Doch der Fall, über den die Schweiz nun diskutiert, ist anders: Der Polizist legte dem Verdächtigen nicht nur Handschellen an, sondern bezeichnete ihn vor zahlreichen Schaulustigen als "Sauausländer" und "Drecksasylant". Der Mann, der 2007 auf der Uhren- und Schmuckmesse in Basel festgenommen wurde, war ein Asylbewerber aus Algerien.

    Aufgrund dieser Äußerungen wurde der Polizist von der Basler Justiz wegen Rassendiskriminierung schuldig gesprochen und zu einer Geldstrafe verurteilt. Der Mann wehrte sich gegen diesen Schuldspruch. Nun hat das Schweizer Bundesgericht in Lausanne geurteilt, dass die genannten Ausdrücke nicht diskriminierend seien, sondern nur eine Beschimpfung darstellten.

    Der Tatbestand der Rassendiskriminierung, um den es hier gehe, setze voraus, dass der Täter eine Person oder eine Gruppe "wegen ihrer Rasse, Ethnie oder Religion" öffentlich herabsetze oder diskriminiere. Bei Äußerungen wie "schwarze Sau" oder "Saujude" sei der Bezug zu Rasse, Ethnie oder Religion ohne Weiteres gegeben. Bei "Sauausländer" oder "Drecksasylant" hingegen fehle er.

    Die "Neue Zürcher Zeitung" schlussfolgert: "Wer einen dunkelhäutigen Mann als 'schwarze Sau' tituliert, begeht demnach einen rassistischen Angriff, wer denselben Mann als 'Drecksnigerianer' bezeichnet, nicht."

    Außerdem urteilte das Gericht in Lausanne, dass Begriffe wie "Sau" oder "Dreck" im deutschen Sprachraum seit jeher häufig verwendet würden, um jemanden zu beleidigen. Sie würden daher als bloße Beschimpfung, nicht aber als Angriff auf die Menschenwürde empfunden.

    Die Entscheidung des Bundesgerichts dürfte die Diskussion über die Behandlung von Ausländern in der Schweiz weiter anheizen. Das Land war international in die Kritik geraten, nachdem sich die Wähler in einem Referendum mehrheitlich dafür aussprachen, die Einwanderung aus dem EU-Ausland zu begrenzen.
