Mit der massiven Beschattung von Moscheen und anderen Orten hätten Ermittler der New Yorker Polizei Muslime nicht diskriminiert, befand Bezirksrichter William Martini am Donnerstag. So diene die Spionage der Aufdeckung von „keimenden terroristischen Verschwörungen."

    Geklagt hatten im Jahr 2012 acht Muslime, darunter der frühere Rektor einer islamischen Mädchenschule. Sie führten ins Feld, dass die Überwachungspraxis der New Yorker Polizei verfassungswidrig sei, weil sie auf Religion, Abstammung und ethnischer Zugehörigkeit abziele.

    Die Kläger warfen Beamten zudem vor, seit 2012 unbescholtene Bürger in etlichen Moscheen, Restaurants und Schulen im US-Staat New Jersey überwacht zu haben.

    Das sah Richter Martini anders. Die Kläger hätten nicht plausibel zeigen können, dass sie lediglich aufgrund ihrer Religion in den Fokus der genommen worden seien. Die Polizei hätte vor Ort nicht möglichen islamistischen Terroraktivitäten nachspüren können ohne die muslimische Gemeinde selbst zu überwachen, hieß es in der schriftlich eingereichten Urteilsbegründung weiter.

    Darin ging der Richter auch auf die Nachrichtenagentur AP ein, die die Klage mit ihrer Berichterstattung über vertrauliche Dokumente der Polizei ins Rollen gebracht hatte. Aus den Papieren ging hervor, wie Beamte im Rahmen ihrer Ermittlungen Dutzende Moscheen und muslimische Studentengruppen unterwandern und gegen Hunderte Personen in New York und andernorts vorgehen wollten.

    Das Zentrum für Verfassungsrechte CCR, das die Kläger vertreten hatte, nannte das Urteil beunruhigend. Mit der Entscheidung habe das Gericht die rechtliche Billigung der gezielten Diskriminierung von Muslimen im ganzen Land ermöglicht, erklärte CCR-Vertreter Baher Azmy.
